JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2016 Learned counsel for the petitioner is permitted to make necessary correction in the petition, as prayed for. Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 303,504 and 452 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that on 15.3.2016 when the husband of the informant was out of house the petitioner along with two others came and abused the husband of the informant by calling the caste name. On protest being made it is conveyed by the petitioner that the husband of the informant has taken money and if the money is not returned her husband would be killed. It is

Patna High Court Cr.Misc. No.18376 of 2016 (2) dt.29-04-2016 2/2 also alleged that the accused persons assaulted the informant by catching hold of her hair.

It is submitted by the learned counsel for the petitioner that the husband of the informant took loan from the petitioner side and when loan amount was demanded the accusation has been levelled. At earlier point of time the petitioner side lodged Barbigha P.S. Case No. 379 of 2015 against the husband of the informant. It is further submitted that for the occurrence of 15.3.2016 the FIR was registered on 20.3.2016. Considering the delayed lodging of the case and the case of petitioner side being lodged at earlier in point of time, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sheikhpura in connection with SC/ST P.S. Case No.6 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
