JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2015 Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 307, 323, 324, 406, 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. Though the accusation of assault and causing injury have also been levelled.
The petitioner and the informant are present. The factum of marriage between the petitioner and the informant and birth of a female child are admitted facts.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.7810 of 2015 (3) dt.12-05-2015 2/3 petitioner that brother of the petitioner has lodged a case with similar accusation in the State of Uttar Pradesh being Turkpatti P.S. Case No. 125 of 2013. The petitioner has also filed Matrimonial Case No. 570 of 2013, though for restitution of conjugal life.
The petitioner is ready to keep the informant as wife with full dignity and honour. A statement to that effect has been made in para 7 of the petition which reads as follows:- "That the petitioner happens to be the husband of the informant and he is ready to keep his wife(informant) with all respect and dignity" The offer is acceptable to the informant. The petitioner is ready to take the informant and their child from her house to the matrimonial house within a period of one week to keep them with full dignity and honour.
Considering the present stand of the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kuchaikote P.S. Case No. 171 of 2013.
The informant will be at liberty to file
Patna High Court Cr.Misc. No.7810 of 2015 (3) dt.12-05-2015 3/3 appropriate application for cancellation of bail of the petitioner, if the petitioner fails to comply the undertaking given before this Court.
