The petitioner apprehends his arrest in a case under Sections 420, 467, 468 of the Indian Penal Code and Section 7(i)(a)(ii) of the Essential Commodities Act. The police intercepted a truck bearing registration no. WB 59A 7147 from which 150 bags of fertilizer were seized. The driver of the truck Md. Zakir disclosed that he loaded the fertilizer from a godown which belongs to Prem Kumar Agrawal and, on such, the fertilizer was recovered from the godown of Prem Kumar Agrawal. The driver further disclosed that Neeraj Jha asked him to load the fertilizer and when the police enquired from Neeraj Jha, he disclosed to enquire about the matter from Munna Singh on his Mobile No. 09801416115 but the said mobile was found switched off. It appears that the petitioner was not

Patna High Court Cr.Misc. No.16422 of 2016 (2) dt.10-05-2016 2/2 apprehended on the spot. The name of the petitioner surfaced in the disclosure made by the driver.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Katihar in Katihar Muffasil P.S. Case No. 22/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
