ANJANA MISHRA ORAL ORDER 01-07-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners No. 1 and 2 apprehend their arrest in connection with a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. Diary in this case was called for earlier which has since been received.
After hearing learned counsel for the petitioners and learned counsel appearing on behalf of the State, it appears that though the deceased was found hanging from the roof, later on, it came to light that she had committed suicide. It is further submitted that the petitioner No. 2 as well as her husband, being mother-in-law
Patna High Court Cr.Misc. No.17882 of 2016 (3) dt.01-07-2016 P2/2 and father-in-law respectively of the deceased lady have had no role to play.
Considering the entire facts and circumstances and also that there being no specific allegations against these petitioners, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gaya, in connection with Buniyadganj P.S. Case No. 221/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
