This application, for grant of regular bail, arises out of Chapra Mufassil Police Station Case No. 351 of 2020, disclosing offences under Sections 461, 379, 411 of the Indian Penal Code.

The allegation against the petitioner is that the stolen mobiles were recovered from the shop of the petitioner. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case on the basis of confessional statement of co-accused, Vikky Kumar, Learned counsel next submits that petitioner is not named in the FIR and

No.35392 of 2020(3) dt.03-02-2021 2/2 he has been running a shop dealing with the mobile phones and he purchased the mobile phones from somebody else on payment basis but petitioner has been arrested alleging that the mobile phones purchased by him are the stolen mobiles. Learned counsel next submits that the petitioner is in custody since 28.08.2020.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 28.08.2020 having no criminal antecedent, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, Ankaj Kumar @ Ankaj Kumar Singh, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-9th Saran, Chapra, in connection with Chapra Mufassil Police Station Case No. 351 of 2020.
