JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201 of the Indian Penal Code.

As per the prosecution case, on 29.03.2021 this petitioner took away her son and on 01.04.2021 dead body of her son was found in a field.

Learned counsel appearing for the petitioner submits that informant is not an eye witness of the occurrence and petitioner has been made accused in this case only on suspicion due to family dispute after lapse of three days when dead body of son of informant was found. In fact informant was residing at her matrimonial house for last one year and petitioner never visited there at any point of time. Petitioner is in custody since

Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner is husband of informant and there is specific allegation against him that he took away son of informant with him and thereafter dead body of son of informant was found in a field.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
