2. The petitioner is apprehending his arrest in connection with Sabour P.S Case No. 687 of 2023 dated 31.12.2023 registered for the offence punishable u/s 341, 323, 307, 353, 332, 333 read with Section 34 of the Indian Penal Code and 25(1-B)a, 26, 35 and 27 of the Arms Act.
3. The brief facts of the case is that on 31.12.2023 at about 12.30 hours the S.H.O of Goradih police station got secret information that some miscreants present in the Scorpio and all were carrying weapon and planned to commit offence. Thereafter, informant gave information to his senior police officer. Thereafter, the informant alongwith other police officials reached Pithna Madarsha, then proceeded to Pithna Kurudih and

No.48070 of 2025(2) dt.29-08-2025 2/3 when they reached at Lucky Bricks Enterprises Factory, informant saw that one white colour Scorpio came and seeing the police party, they tried to move their Scorpio and when police officials tried to stop Scorpio, then one person who was present in Scorpio said to fire against the police officials. Thereafter, miscreants fired bullet due to which one A.S.I. namely Pawan Kumar escaped somehow and then police officials caught two miscreants who disclosed their names Kaju Yadav and Rajesh Yadav. It is further alleged that country made pistol, bullet, Scorpio and mobile were seized and prepared search-cum seizure list and arrested both accused persons. Thereafter, on inquiry, both accused persons disclosed the names of other miscreants
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the name of the petitioner has transpired in this case on the disclosure of the apprehended coaccused person. It is further submitted that petitioner is a labour, he is out of the State for his livelihood and he has no knowledge about the alleged occurrence. There is no any overt act against the petitioner rather the allegation against the petitioner is general and omnibus in nature. No any incriminating material
Patna High Court CR. MISC. No.48070 of 2025(2) dt.29-08-2025 3/3 has been recovered from the conscious possession of the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Bhagalpur in connection with Sabour P.S. Case No. 687 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure, with further condition: (I) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
