JUSTICE RAVI RANJAN ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 7 of Essential Commodities Act.

As per the allegation, four bags of rice were seized from a Rickshaw and Rickshaw-puller had stated that rice belong to the petitioner, who is the Chairman of PACS concerned. It is contended on behalf of the petitioner that seizure list indicates that seizure was from the house of one Sunil Kumar, who was previous PDS licence holder. Nothing was recovered from his house and the accusation against the petitioner is only on the basis of statement of Rickshaw-puller from where recovery was made. The petitioner claims to have clean antecedent.

Case No.218/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
