The petitioner seeks anticipatory bail in connection with Sonbarsa Raj (Kash Nagar O.P.) P.S. Case No. 43 of 2013 registered under Sections 143, 341, 504 and 353 of the Indian Penal Code.

It has been contended that the FIR is based on the self-statement of the Incharge of Kash Nagar O.P. and a perusal of the same would make it clear that apart from the persons named in the FIR, no other person was involved in the case. However, in course of investigation, the investigating officer is

Patna High Court Cr.Misc. No.36230 of 2014 (2) dt.01-04-2015 2 / 2 trying to arrest the petitioner also in the aforesaid case. It has further been contended that the petitioner, being man of clean antecedent, has never been made accused in any other criminal case.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, let the petitioner be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sonbarsa Raj (Kash Nagar O.P.) P.S. Case No. 43 of 2013 subject to the conditions as laid down under Section 438(2) Cr. P.C.
