JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2025 Heard learned senior counsel appearing on behalf of the petitioner, learned A.P.P. appearing on behalf of the State and learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 303(2), 352 and 3(5) of the B.N.S. and Sections 3 and 4 of the Bihar Witchcraft Prevention Act.

3. As per prosecution case, it is alleged that this petitioner, along with co-accused Puja Kumari, assaulted mother of informant with lathi.

4. It is submitted by learned senior counsel for the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, both parties are Gotiya and due to

Patna High Court CR. MISC. No.37786 of 2025(3) dt.19-09-2025 2/2 partition dispute between the parties, this false and concocted case has been lodged. Charge-sheet has already been submitted and petitioner is in custody since 30.03.2025.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, relationship between the parties and period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Rajepur P.S. Case No. 213 of 2024.
