JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Chapra Muffasil P.S. Case No. 238 of 2014 registered under Sections-307, 354, 379 & other minor sections of the Indian Penal Code.

The accusation against the petitioner No. 1 is that he tried to outrage the modesty of informant's wife and when, protest was made, he assaulted the informant by iron rod causing injury on his head and so far as the petitioner No. 2 is concerned; it is stated that he gave one dagger blow causing injury on the head of the informant.

Patna High Court Cr.Misc. No.9647 of 2015 (2) dt.13-03-2015 2/2 Learned counsel for the petitioners submits that much prior to filing of the present case, Muffasil P.S. case No. 200 of 2011 was lodged against the informant and others by uncle of petitioners and for the occurrence of the same day, the brother of the petitioners lodged Chapra Muffasil P.S. Case No. 232 of 2014 and as a matter of fact, in retaliation of above-said two cases, the present false case has been lodged against the petitioners and others. It is further contended by him that no injury on the head of informant was found and he has received simple injuries.

Considering the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest or surrender in the court below within four weeks from today, the petitioners named-above, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Chapra Muffasil P.S. Case No. 238 of 2014 to the satisfaction of Chief Judicial Magistrate, Saran at Chapra subject to conditions as laid down u/S 438(2) of the Cr. P.C.
