2. The petitioner seeks bail, who is in custody since 06.02.2026 in connection with Madhubani Cyber P.S. Case No. 08 of 2026, corresponding to G.R.No.365/2026, F.I.R. dated 05.02.2026 registered for the offence punishable under Sections 318(4), 319(2), 336(3), 337, 338, 339, 340(2), 341(1), 111, 61(2) and 3(5) of BNS, 2023 and Sections 42(1),42(2),42(3) (c),42(3),(e),42(3)(f),42(6) and 43 of the Telecommunication Act, 2023 and Sections 66,66(c),66(D) & 72 of the Information Technology Act, 2000 (I.T.Act).

3. Allegation against the petitioner is of committing

2/4 cyber crime and he is operator of SIM Box (Sophisticated setup) and several electronic devices have been recovered from his house.

4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. He has been made accused in the present case on the basis of suspicion and except the suspicion, no other cogent material has come during investigation against the petitioner to suggest the involvement of the petitioner in the present occurrence.

Learned APP for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that from a bare perusal of the FIR it appears that the informant along with Madhubani Cyber Police official and other local police official of Madhubani reached at the house of the petitioner and arrested him. Upon search total 18 items (i) 7 SIM box with 20 slot (ii) VI several SIMs of Airteland Jio(iii) VI several SIM rapper of Airtel and Jio (iv) 22 Mobiles (v)5 TP link electronic device (vi) 02 Airtel Xstream Fiber Router (vii) 03 TP link device TL-R5408 PE - AC 2.5 G PoE (viii) 03 TIP link charger (ix) 01 USB charger (x) 04 phone's mother board

3/4 (xi) 25 charging cable (xii) 06 computer cable (xiii) 10 cable (xiv) 01 Acer Laptop (xv) 01 SBI debit Card Rupay (xvi) 01 Trolley bag (xvii) total Rs. 1,68,000/- cash (xviii) other electronic devices and Papers viz pan, Aadhaar and others has been recovered from the house of Mandeep Kumar i.e. petitioner herein and petitioner has disclosed the name of his associates.

It appears from the aforesaid, the petitioner alongwith other co-accused persons of forming an organized cybercrime gang and criminal conspiracy to illegally route VOIP calls into local calls through SIM boxes causing revenue loss to the Government of India and Telecom Companies and it appears that possessing fake SIM cards, committing forgery, engaging in cybercrime and obtaining SIM Cards using forged documents which suggests that the petitioner has involved in the present crime in question and it also appears that the petitioner is operator of SIM Box (Sophisticated setup) and several electronic devices have been recovered from the house of the petitioner and the same is dangerous to the general public enlarge and also detrimental to the internal security of the country and allegation against the petitioner is very serious in nature.

6. Considering the aforesaid facts, I am not inclined

4/4 to enlarge the petitioner on bail in connection with Madhubani Cyber P.S. Case No. 08 of 2026, corresponding to G.R.No.365/2026 pending in the court of learned Chief Judicial Magistrate, Madhubani.

7. Prayer is refused.
