JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Siswan P.S. Case No. 138 of 2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner. He further submits that petitioner is not owner of the motorcycle. Petitioner is in custody since 22.05.2023.

Learned APP has vehemently opposed the prayer for bail.

Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court. II, Siwan in connection with Siswan P.S. Case No. 138 of 2023. This is also subject to the conditions that (I) the petitioner shall mark his presence in Siswan Police Station, District- Siwan on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
