JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being transporter is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act.

One hundred ninety two bags of rice were seized while being transported, suspected to be the case of black-marketing. It is submitted by the learned counsel for the petitioner that the rice was being transported from BSFC and on way to its destination the trucks were intercepted. It is further submitted that the District Magistrate entrusted enquiry to the DSO and the enquiry report of DSO (Annexure 2) suggests that the grains were being carried through prescribed route and the trucks were heading towards their destination when seizure was made. Statement has been made in

Patna High Court Cr.Misc. No.11430 of 2015 (2) dt.30-04-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Amdabad P.S. Case No. 181 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
