ANJANA MISHRA ORAL ORDER 27-06-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State and learned counsel for the Informant.
The petitioners being Bhaisur and Gotni of the deceased lady apprehend their arrest in connection with a case registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioner and his wife are living separately from entire family and no particular role has been attributed to them in the First Information Report. It is further submitted that there is general and omnibus allegations against the all family members including these petitioners.
Patna High Court Cr.Misc. No.18136 of 2016 (3) dt.27-06-2016 P2/2 Diary in this case was called for earlier which has since been received.
Learned counsel for the State after perusal of the case diary submits that there is no further material in the case diary, save and except, the allegations as made out in the First Information Report which are indeed general and omnibus in nature. Considering the aforementioned facts and circumstances, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 130/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
