2. The petitioner apprehends his arrest in connection with Raniganj P.S. Case No. 09 of 2023, registered for offence punishable under Section 392 of the Indian Penal Code.
3. As per allegation, on 04.01.2023 the informant was returning from his office and when he reached near Parmanandpur Ward No. 13, three accused persons on a motor cycle overtook and stopped him, and at the point of pistol, they snatched Rs. 16,000/- and a mobile phone from his possession. They also threatened to kill had he chased.
4. The learned counsel for the petitioner has submitted that the entire allegation against the petitioner is false. The
Patna High Court CR. MISC. No.39445 of 2023(2) dt.31-07-2023 2/2 petitioner is said to be purchaser of the mobile set looted away from the informant. It is a fact that the mobile was not recovered from the possession of the petitioner, rather it was recovered from another accused.
5. On the other hand, the learned APP has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances as well as clean antecedent and also considering the fact that the petitioner is not named in the FIR, the prayer for bail is allowed.
7. Let the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Araria in connection with Raniganj P.S. Case No. 09 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
