JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Khaira P.S. Case No. 132 of 2014 registered for the offences punishable under Sections 147, 148, 149, 342, 323, 307, 326, 504 of the Indian Penal Code.
There is case and counter case between the parties and persons from both the sides sustained injury. In the present case, one injured sustained grievous injury on his wrist said to be caused by hard and blunt substance whereas in the counter case, petitioners no. 1 and 4 are said to have sustained grievous injury
Patna High Court Cr.Misc. No.12556 of 2015 (2) dt.07-05-2015 on their vital parts of the body. Moreover, co-accused, Nageshwar Yadav @ Nago Yadav and others have already been admitted to anticipatory bail by the learned Sessions Judge, Jamui itself. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri U.K. Pandey, Judicial Magistrate 1st Class, Jamui in Khaira P.S. Case No. 132 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
