Mr. Pronoti Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-08-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Informant has suspected the hand of the petitioner and one Ragani Kumari in the murder of his son, who had gone to Mahendru market for buying books but he did not return thereafter.

It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case due to suspicion. There is no eye witness to the occurrence and simply on the ground that the deceased was in habit of going to the

Patna High Court CR. MISC. No.38184 of 2019(3) dt.14-08-2019 2/2 house of said Ragani Kumari at Muzaffarpur for last two years, has been implicated in this case. Petitioner has got no criminal antecedent.

Considering the facts aforesaid, let the petitioner above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rail, Patna/successor Court in connection with Patna Junction (Rajendra Nagar) P.S.Case No.102 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
