2. The petitioner is apprehending arrest in connection with Chapra Muffasil P.S. Case No. 108 of 2025 instituted under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 3(5) of the Bhartiya Nayay Sanhita, 2023 lodged on 26.02.2025 by the informant, Arjun Kumar.
3. As per the prosecution story, the informant alleged that as he was going to Maharajganj, the accused intercepted alongwith some unknown persons and after abuse, snatched the amount/golden chain, was assaulted by the petitioner and Himanshu Singh on his head causing injury. This led to the FIR.
4. Though, learned counsel for the petitioner tried to impress upon this Court that earlier a complaint was filed which led to the present counter case by the informant's side, learned
Patna High Court CR. MISC. No.38778 of 2025(3) dt.16-10-2025 2/2 APP has taken this Court to the learned Sessions Judge order to show that the assault on the head has been found to be grievous in nature.
5. Taking into account the aforesaid facts, no relief can be extended to the petitioner and the anticipatory bail application stands rejected.
6. If the petitioner surrenders within a period of four weeks from today, the Court concerned shall take up the matter and dispose it of preferably on the same day. (Rajiv Roy, J) Ravi/- U T
