JUSTICE RAVI RANJAN ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offences punishable under sections 379/120B of the Indian Penal Code and sections 4(1A), 21(1) of the D.E. Act, section 41(1) of the B.M. Act and sections 33, 41 and 42 of the Forest Act. It is contended that without any recovery or seizure list prepared allegation has been made that the petitioner along with 22 other persons was involved in business of dealing in illegal stone chips. It is further contended that two accused persons, namely, Bharat Sah and Sudarshan Sah, have been enlarged on bail by a Coordinate Bench of this Court vide order dated 20.04.2016 passed in Criminal Miscellaneous No. 14417 of 2016. The petitioner claims to have clean antecedent.

No.18538 of 2016 (2) dt.06-05-2016 Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Shyam Sundar Sah @ Shyam Sundar Prasad Gupta, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Dehri(T) Police Station Case No. 592 of 2015 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Dehri, District Rohtas, subject to the conditions laid down under subsection (2) of Section 438 of the Code of Criminal Procedure.
