The application seeks a direction upon the respondents to hand over the construction work of the building/bath room to the newly elected School Committee of which she has claimed to be the Secretary. On a bare perusal of the relief(s), it appears the writ application has become infructuous.

Counsel for the State has drawn attention of the Court to para 7 of the counter affidavit and submits that the petitioner, in fact, was never declared Member of the ad hoc Committee. She was never elected as Secretary unanimously in

Patna High Court CWJC No.16883 of 2013 (2) dt.27-04-2016 2/2 presence of the Block Education Officer. Her status as Secretary is also under challenge. No rejoinder to the counter affidavit is filed. In the aforesaid circumstances, this Court finds no merit in the application which otherwise has also lost its relevance. The application is dismissed.
