2. The petitioner seeks bail in connection with Agiaon Bazar PS Case No.55 of 2024 dated 27.04.2024 instituted for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. The allegation is of recovery of 100 litres country made mahua liquor from the tempo.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel further submitted that the petitioner is either driver nor owner of the auto. He has no concern with the auto. Petitioner was the bonafide passenger of the auto. The

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Judge, Excise Court, 1st, Bhojpur at Ara, in Agiaon Bazar PS Case No.55 of 2024.

7. The application stands allowed.
