The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, when the informant who was driver of the bus, reached near Bilat Chowk one person was coming by driving motorcycle rashly and negligently dashed the rear wheel of the bus as a result of which be became badly injured. Thereafter, when the informant reached near VillagePakauli petitioner and other accused persons came and got down the informant from the bus and this petitioner wrapped Gamchha around his neck and snatched Rs. 20,000/- from his pocket.

No.39569 of 2022(2) dt.24-11-2022 2/2 It is submitted that as a matter of fact, the informant who was driving the bus negligently dashed the motorcycle and the person who was driving got injured. Due to said accident the altercation took place between the parties. There is no specific allegation against this petitioner.
Considering the facts aforesaid and the backdrop in which altercation took place, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 370 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
