The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that 8 packets rice of mid-day-meal were recovered from the shop of the petitioner.

It is submitted by learned counsel for the petitioner that maliciously the accusation has been levelled against the petitioner. It is further submitted that the petitioner is not a PDS dealer and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.15867 of 2015 (2) dt.16-04-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Marhowrah P.S. Case No.42 of 2015, pending before the Sub-Divisional Judicial Magistrate, Saran, Chapra.

With the above observation, this application is, accordingly, disposed off.
