JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offence punishable under Section 376 of the Indian Penal Code.

It is alleged that the son of the petitioner, namely, Shadab Alam came to the house of the informant and gave two laddu to eat, thereafter she got intoxicated when he ravished her and continued with physical relationship for long. Thereafter the informant gave birth a child. It is further alleged that the petitioner and his wife failed to give accommodation in the matrimonial house and used to threaten her.

Considering the fact that the thrust of accusation is against the son of the petitioner and statement has been made in

Patna High Court Cr.Misc. No.9138 of 2015 (2) dt.04-03-2015 2/2 para-3 of the petition that the petitioner has no criminal antecedent let the petitioner named above be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S.Case NO. 183/2014, G.R. No. 864/2014, subject to the conditions as laid down under section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Sujit/- U
