The petitioner is languishing in custody for the offences punishable under Sections 304B/498A/201/34 of the Indian Penal Code.

Submission is that the petitioner is husband of the so-called victim of dowry death. In fact, the wife of the petitioner died natural death and the family members of the complainant participated in the cremation and thereafter false complaint case was lodged for non-fulfillment of dowry death just to pressurize. Admittedly, marriage was solemnized eight years prior to death. Hence, presumption of dowry death is not there.

No.36663 of 2019(2) dt.18-06-2019 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.215 of 2018, arising out of Complaint Case No.3517 of 2010, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
