The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 302/201/120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that in the present case, the petitioner is apprehending his arrest only on the basis of suspicion as he was one of the persons who had purchased land from the deceased. He further submits that the petitioner was not named in the First Information Report but subsequently on the account of said circumstances his name has cropped up along with several other persons. He also submits that similarly situated persons who had also purchased land, has been granted privilege of anticipatory bail by this Court in a batch of
Patna High Court Cr.Misc. No.14831 of 2015 (3) dt.31-08-2015 P2/2 cases (Cr. Misc. No. 12794 of 2015, Cr. Misc. No. 13819 of 2015 and Cr. Misc. No. 25094 of 2015) which was disposed of along with Cr. Misc. No. 12098 of 2015 vide order dated 30.07.2015. Considering aforesaid circumstances and also because there is no other cogent material available in the case diary, let the petitioner, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Kargahar P.S. Case No. 40/14 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
