In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 341, 323, 504, 342 and 498 (A)/34 of the I.P.C. Allegedly, the mother and uncle of the informant married her with this petitioner against her will and when she went to her Sasural she was assaulted and tortured by the petitioner resulting she left her matrimonial house and did not go to her parental home due to fear and lived at her friend's house for 2-3 days.

Submission is that the informant herself does not want

Patna High Court Cr.Misc. No.38854 of 2014 (2) dt.01-04-2015 2/2 to live with the petitioner. The petitioner always tried to keep her in a good and healthy atmosphere.

This is a peculiar case wherein mother and uncle have also been made accused.

The learned A.P.P. opposes the prayer for pre-arrest bail.

In the peculiar facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Muzaffarpur in Town P.S. Case No. 394 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
