JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. The victim is still traceless. It is submitted by learned counsel for the petitioner that the petitioner has performed marriage with the victim and now the petitioner has a child also from the wedlock. This Court is not inclined to interfere since the case was instituted in the year 2009.

However, if the victim appears before the learned court below within a period of six weeks and admits that she of her own married with the petitioner then the prayer for regular bail of the

Patna High Court Cr.Misc. No.9584 of 2015 (2) dt.11-03-2015 2/2 petitioner will be considered by the learned court below in connection with Kateya P.S. Case No. 12 of 2009 pending in the court of learned CJM, Gopalganj.
