JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner and the State. The petitioner being husband of the victim is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.
The accusation is of killing the sister of the informant just after one year of marriage for non-fulfillment of dowry demand. The marriage of the victim and petitioner was performed on 23.05.2013 and the victim was died on 14.06.2014.
It is submitted by learned counsel for the petitioner that the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court
Patna High Court Cr.Misc. No.13144 of 2015 (2) dt.31-03-2015 2/2 below where the informant has stated that the victim died due to accidental burn injury.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Karagahar (Sidhi) P.S. Case No.145 of 2014, pending before the Judicial Magistrate, 1st Class, Rohtas at Sasaram.
With the above observation, this application is, accordingly, disposed off.
