JUSTICE PRABHAT KUMAR JHA ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned APP. The petitioner apprehends his arrest in Sahiyara P.S. Case No. 142 of 2014, registered for the offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.
The petitioner along with Birendra Singh @ Virendra Kumar Singh are said to have executed a sale deed in favour of Rahmat Sah.
Learned counsel for the petitioner submits that the informant is cousin of the petitioner. The land was standing in the name of Jagdish Singh father of Birendra Singh @ Virendra Kumar Singh. The petitioner is cousin of the informant and the
Patna High Court Cr.Misc. No.16189 of 2015 (2) dt.29-04-2015 2/2 property was joint family property. It has further been submitted that Birendra Kumar Singh @ Virendra Kumar Singh and Suraj Kumar Singh have already been enlarged on anticipatory bail in Cr. Misc. No. 9221 of 2015.
Considering the facts aforesaid and the fact that the case of the petitioner stands on the same footing, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sahiyara P.S. Case No. 142 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
