JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Jaynagar P.S. Case No.213 of 2020, registered for the offence punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. The petitioner is in custody since 20.08.2020, after he surrendered before the Court below in connection with the prohibition case. It is alleged in the First Information Report that 54 liters of country made liquor was recovered from the veranda of the petitioner's house.
Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has no criminal antecedent and his conduct of surrendering before the Court below, after having learnt about his implication in the criminal
Patna High Court CR. MISC. No.35412 of 2020(3) dt.15-01-2021 2/2 case, suggests that there is no likelihood of his fleeing from the course of trial.
Considering the quantity of liquor, said to have been recovered and the date with effect from which the petitioner is in custody and the submissions made on behalf of the petitioner, as noted above, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani, in Jaynagar P.S.
