JUSTICE SATYAVRAT VERMA ORAL ORDER 30-06-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that petitioner fired at him causing injury in the abdomen.

The learned counsel for the petitioner submits that the informant subsequently realizing his mistake that the occurrence

No.48990 of 2021(3) dt.30-06-2022 2/2 was not committed by the petitioner and has compromised the case and the learned counsel for the informant, who appears and also submits that informant has no issues against the petitioner. Considering the submissions made by the learned counsel for the petitioner and also taking into consideration of the fact that the informant does not want to pursue the case against the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Bihta P. S. Case No.355 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
