The petitioner apprehends his arrest in a case under sections 379, 406, 417 of the Indian Penal Code and Section 138 of the N.I. Act.
The complainant alleged that the petitioner took rupees five lacs for establishing his shop but the petitioner did not return the money and the cheque given by the petitioner could not be honoured.
It is submitted that the petitioner had already returned money to the complainant but the cheques given in security were not returned to the petitioner. It appears that there is a dispute between the
Patna High Court Cr.Misc. No.37629 of 2014 (2) dt.19-03-2015 petitioner and the complainant about return of money. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in connection with Complaint Case No. 1727 of 2013,T R.
