The petitioners apprehend their arrest in Baniapur P.S. Case No. 220 of 2013, registered for the offences punishable under Section 436 and other Sections of the Indian Penal Code, Section 27 of the Arms Act and Sections 3(i)(x)(xv) of the SC/ST Act. The informant named the petitioner along with other accused persons including Shambhu Singh and alleged that Shambhu Singh tried to outrage the modesty of her daughter and on protest made firing. It is further alleged that Shambhu Singh was brutally assaulted and thereafter the informant named the accused persons and alleged that they came and ransacked the house and set ablaze her house. Patna High Court Cr.Misc. No.7066 of 2015 (2) dt.20-02-2015 2/2 Kuar the mother of the deceased Shambhu Singh lodged Baniapur P.S. Case No. 218 of 2013 under Section 302 of the Indian Penal Code against Mahesh Nut and others. Mahesh Nut is the husband of the informant Radhika Devi. The S.I. also lodged a case bearing Baniapur P.S. Case No. 219 of 2013 against Nilmani Singh and others under Section 380 for making protest against the police and ransacking the house.

It appears that the husband of the informant and others killed one Shambhu Singh thereafter the villagers made protest and ransacked the house of the informant and other accused persons. No specific allegation is made against the petitioners. Considering the facts aforesaid the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Brijesh Kumar, the learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Baniapur P.S. Case No. 220 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
