The petitioner has preferred this application for grant of regular bail in a case registered under sections 419, 420, 467, 468 and 34 of the Indian Penal Code.

As per the prosecution case, amounts were illegally withdrawn by one Rajesh Mukhiya from the Uttar Bihar Gramin Bank and it is stated that the petitioner who was the cashier - cum - clerk in the Bank assisted him in the same. It is further stated that the said Rajesh Mukhiya has deposited the entire amount back in the Bank and thus the amount has been recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Even

Patna High Court CR. MISC. No.48310 of 2021(2) dt.10-02-2022 2/2 as per the allegation the amount has been recovered by the Bank from Rajesh Mukhiya. The petitioner is in custody since 17.6.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation and investigating in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Manigachi P.S. Case no. 43 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Darbhanga.
