The petitioner seeks bail in connection with Amarpur (Fullidumar) P. S. Case No.346 of 2021, corresponding to Special Excise Registration No.504 of 2021 instituted for the offences under Sections 30(a)(g) and 32(2) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is that the house of the petitioner was raided on secret information and 20 litre of mahua liquor was recovered from his courtyard.

No.48936 of 2021(2) dt.17-12-2021 2/2 The learned counsel for the petitioner submits that petitioner has no concern with the seized liquor and the same was recovered from an open area behind the house and as such, petitioner was not aware, who kept the liquor in the courtyard in the open space behind his house.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 09.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd -cum-Special Judge Excise Act, Banka in connection with Amarpur (Fullidumar) P. S. Case No.346 of 2021, corresponding to Special Excise Registration No.504 of 2021.

The application stands allowed.
