JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and under sections 25(1-B) A, 26, 35 of the Arms Act.

The prosecution case is that on secret information that miscreants are preparing to commit dacoity raid was laid while coaccused Lal Babu Mian and Sandip Kumar were apprehended and from their possession arms and ammunitions were recovered. The apprehended accused disclosed the names of co-accused Balwant Singh, Satyendra Rai, Rupesh Kumar @ Gopi.

It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.19756 of 2016 (2) dt.04-05-2016 2/2 that the name of the petitioner came in the second subsequent statement of the apprehended accused after nine days of the occurrence. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-7th, Saran at Chapra in connection with Derni P.S. Case No. 120 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
