JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-02-2021 Heard learned counsel for the petitioner as well as learned counsel for the State through video conferencing. The petitioner seeks bail in Andar Police Station Case No. 156 of 2019 registered for the offences punishable under section 394 of the IPC.

As per the prosecution case, three unknown miscreants came on the motorcycle, shot at petrol pump manager and snatched the key of the cash box and took away Rs.42,000/-. They also took away Rs.20,000/- from the pocket of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent. His name has come in the case on the confessional statement of co-accused Shashi Prakash Shahi and Basant Kumar. No incriminating material has been recovered

Patna High Court CR. MISC. No.35635 of 2020(3) dt.01-02-2021 2/2 from the conscious possession of the petitioner. Charge sheet has already been submitted. He is in custody since 8.11.2019. Learned counsel for the State opposes the prayer for bail. He submits that the petitioner has got criminal antecedent and is accused in seven more criminal cases of almost similar nature as per paragraph 3 of the bail petition itself. In view of the nature of allegation as well as the antecedent of the petitioner, prayer for bail of the petitioner is refused.
