The petitioner seeks bail in connection with Excise Case No.69 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 11.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 93.795 litre of foreign liquor from a Bolero vehicle from which the petitioner was arrested.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 11.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Bhagalpur in connection with Excise P. S. Case No.169 of 2021.

The application stands allowed.
