This application is filed for grant of regular bail to the petitioner who has been made accused in connection with Special Case No.- 26 of 2026 arising out of Vigilance P.S Case No. 26 of 2026 instituted for the offences punishable under Sections 7(a) and 7(b) of Prevention of Corruption Act, 1988 (amended 2018).

3. As per the prosecution case, a complaint was filed by Dharmendra Kumar Patel who is a member of Ward No. 15 under Thorsan Panchayat, Dist.- Rohtas and used to work as a caretaker for Ward No.- 15, for which he is being paid Rs. 2000/- per month by the Panchayat Secretary.

4. The complainant has stated that total Rs. 24,000/- was paid in his account on 18.02.2025 for the period 01.04.2022 to 01.04.2023. The complainant alleged that against the paid amount, Rs. 8000/- was demanded by the petitioner. On 18.12.2025, the petitioner again demanded Rs. 8000/- against the paid amount. On the basis of the said complaint, an FIR was lodged.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged in the FIR. It is further submitted that the entire prosecution story is based on trap proceedings, voice recordings and documentary evidence.

It is further submitted on behalf of the petitioner that the entire case is based on documentary and electronic evidence which is already in the possession of the prosecution and there is no possibility of tampering with the evidence and that the continued detention of the petitioner is unnecessary.

7. The petitioner is having a clean antecedent and is in judicial custody since 27.02.2026.

8. Considering the aforesaid facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten

No.38532 of 2026(3) dt.24-07-2026 3/3 thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, Patna in connection with Special Case No.- 26 of 2026 arising out of Vigilance P.S Case No. 26 of 2026 on the condition that one of the bailors should be family member of the petitioner. It is expected from the trial court to frame the charge at the earliest as charge sheet has already been filed.
