JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 12-08-2015 Heard Mr. Ashish Giri for the petitioner and Mr. Madhuresh Prasad for the BPCL and its functionaries. The application alleges deliberate disregard/disobedience at the hands of the opposite parties of the order dated 16.07.2013 passed in CWJC No. 15153 of 2012 whereby the termination of the dealership of the petitioner vide order dated 31.07.2012 (Annexure-8 to the writ petition) was quashed and set aside. A show cause on behalf of the opposite party nos. 1 & 2 has been filed on 05.08.2015 after service. Mr. Giri does not dispute receipt of the copy of the show cause. On perusal of the statements made in the show cause this Court is satisfied that the opposite parties have now taken steps for compliance of the order passed by this Court on the writ petition after several rounds of litigation inasmuch as offer has been made to the heirs and legal representatives of the deceased original licensee for completing the formalities.

This Court would only observe that on completion of the formalities by the heirs and legal representatives of the original licensee, the authorities of BPCL will pass appropriate order within three weeks thereafter.

The contempt application is disposed of.
