JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-01-2023 Instant anticipatory bail petition has been put up under the heading "To be mentioned" as order no.9 has wrongly been typed and pronounced in the record of Cr.Misc.No. 48154 of 2022 in place of 2021.

In that view of the matter, order no.9 be read as passed in Cr.Misc.No. 48154 of 2021 which is again reproduced herein below:- "Heard learned counsel for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offence punishable under Sections 341, 323, 308/34 of Indian Penal Code.

As per FIR, petitioner No. 1 assaulted on the head of

Patna High Court CR. MISC. No.48154 of 2021(10) dt.18-01-2023 2/3 the informant and petitioner No. 2 assaulted brother of the informant by means of lathi.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. It is next submitted that injuries allegedly caused by these petitioners are simple in nature. Present case is counter blast of Bakhtiyarpur P. S. Case No. 98 of 2020 which was lodged by the son of petitioner No.1 against family members of the informant and others. Petitioners have got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Barh, Patna in Bakhtiyarpur P. S. Case No. 97 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure."

Period of surrender of the petitioners for processing bail bonds is extended by further six weeks.

Registry is directed to delete order no.9 floating in the
