The petitioner apprehends his arrest in Rajiv Nagar P.S. case No. 389 of 2015 under Section 406, 420, 467, 468 of the Indian Penal Code and under Section 3 of Damage to Public Properties Act.
The petitioner and other accused persons are alleged to have doing construction work in the land of Housing Board. It is submitted that petitioner was not apprehended on the spot. There is nothing on record to show that petitioner was doing construction work in the land of Housing Board. No offence under Section 420 or others Sections of the IPC is made out. The petitioner has got no criminal antecedent.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.20781 of 2016 (3) dt.19-07-2016 2/2 allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Saurav Kumar Verma, learned Judicial Magistrate, 1st class, Patna in Rajiv Nagar P.S. Case No. 389 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
