JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-10-2015 The petitioner has prayed for quashing order dated 24.10.2014, passed by respondent no. 3 by which his PDS licence has been cancelled in view of institution of Bahera Police station Case No. 441 of 2014 under section 7 of the EC Act.

The petitioner submits that after 23.6.2011 amendments, a license cannot be cancelled on the ground of pendency of a criminal case.

The submission of the petitioner has substance. In the result, this writ application succeeds. The impugned order is set aside, subject to any fresh right created in the meantime. Shashi.
