At the very outset, submission of the learned counsel for the petitioners is that the prayer for bail of the petitioner no.1 (Anand Bihari Singh) has already been permitted to dismissed as withdrawn vide order dated 9.7.2019.

Petitioner no.1 is apprehending his arrest in connection with Majorganj (Suppi O.P.) P.S.Case no.402/2018 , registered for offences punishable under Sections 147, 148, 149, 333, 353, 307, 221, 337, 338, 427, 323, 504 of the Indian Penal Code and Section 27 of the Arms Act.

It appears from the FIR that when the police raided the place of occurrence in connection with arrest of brother of the

Patna High Court CR. MISC. No.35876 of 2019(5) dt.16-08-2019 2/2 petitioners , who is a dreaded criminal, petitioners and 40-50 other persons attacked the police party, causing injury to some of the police personnel and the petitioners are accused in one more case.

Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against him and injury report discloses that the injuries are superficial in nature. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner no.2, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Sitamarhi in connection with Majorganj (Suppi O.P.) P.S.Case No.402 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With the above direction, this application is allowed.
