JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A, 341, 323, 315, 504, 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfillment of the dowry demand and getting the pregnancy terminated. It is submitted by learned counsel for the petitioners that the accusation of torture is omnibus and general against the petitioners. The police, after investigation, have submitted chargesheet levelling the accusation only under Sections 498A/341/323/504//34. It is further submitted by learned counsel for the petitioners that the thrust of accusation is against the husband.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the
Patna High Court Cr.Misc. No.13177 of 2015 (2) dt.31-03-2015 2/2 learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Madhubani in connection with Bisfi (Patauna) P.S. Case No.28 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
