JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 16-02-2022 Heard both sides through virtual court proceedings. The petitioner apprehends his arrest in Obra P.S. Case No.104 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 315 litres of country made liquor kept beneath hay stack behind the house of the petitioner was recovered. It is submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail application.

Taking into consideration the fact that the liquor was recovered from behind the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
