The petitioners, two in number, apprehend their arrest in a case registered under Section 365 and other sections of the Indian Penal Code.
The complainant-informant alleged that his son Ranjan Kumar was kidnapped on 11.06.2014 and he was forcibly married with the daughter of one Mahesh Singh. Learned counsel for the petitioners submits that the petitioner no. 1 is the brother-in-law of Mahesh Singh and the petitioner no. 2 is the father of the petitioner no. 1. He is an old man aged about 75 years. The informant is not an eye witness of the occurrence. It is further submitted that the victim has alleged that the petitioners and other forcibly took him to the house of Mahesh Singh and married him with Veena Kumari.
Patna High Court Cr.Misc. No.6785 of 2015 (2) dt.19-02-2015 2/2 It appears that the petitioners are relatives of Mahesh Singh. Veena Kumari also lodged a case under Section 498A and other sections of the Indian Penal Code.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Warsaliganj P.S. Case No. 146/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
