JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.

The prosecution case is that father of the petitioner, namely, Shiv Shankar Prasad Singh, being Branch Manager of Madhya Bihar Gramin Bank, branch Dihra, in between 10.12.2012 and 09.06.2014, by making forged voucher, get transferred Rs. 3,93,805.42 from sundry account of the bank to the account of petitioner.

It is submitted by the learned counsel for the petitioner that petitioner was not the Branch Manager and the transfer was also not made by him as the same was made by his father, and on undertaking of the father of the petitioner that he will deposit the

Patna High Court Cr.Misc. No.19746 of 2016 (2) dt.04-05-2016 2/2 entire alleged amount, a coordinate bench of this court granted bail to the father of the petitioner vide Cr. Misc. No. 14666 of 2015. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that thrust of accusation is against the father of the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 150 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

It is submitted by learned counsel for the petitioner that father of the petitioner has already deposited the entire alleged amount.

The bail bonds of the petitioner shall be accepted by the learned court below on verification of the fact that father of the petitioner has already deposited the entire alleged amount. BKS/- (Dinesh Kumar Singh, J) U T
